Terms of Use & Legal Notices
Please read these terms carefully. They set out the rules that apply when you use GIRA’s website, member portals, and data services, together with the legal notices governing our published standards and benchmarks.
Scope & acceptance
These Terms of Use (the “Terms”) govern access to and use of the website, portals, data dashboards, and related services (collectively, the “Services”) operated by the Global Inflight Retail Association (“GIRA”, “we”, “us”).
By accessing the Services you agree to be bound by these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, you must not use the Services.
Definitions
The following terms have the meanings set out below wherever capitalised in this document:
- Member — an airline, supplier, or service provider admitted to GIRA under the applicable membership category.
- Content — any text, data, benchmarks, reports, or materials made available through the Services.
- Aggregated Data — anonymised and combined data sets from which no individual Member can be identified.
- Secretariat — the administrative body responsible for the day-to-day operation of GIRA.
Membership & eligibility
Membership is open to organisations active in the inflight retail value chain that meet the eligibility criteria set out in the GIRA Statutes. Admission, categories, fees, and renewal are governed by those Statutes and any rules adopted by the Board.
GIRA operates as a neutral, independent platform. Membership does not confer any control over the association’s positions, standards, or published benchmarks.
Acceptable use
When using the Services you agree not to:
- misrepresent your identity, organisation, or authority;
- access, scrape, or extract data by automated means except where expressly permitted;
- attempt to re-identify individual Members from Aggregated Data;
- use the Services to share commercially sensitive information in breach of competition law;
- interfere with the security or integrity of the Services or any connected systems.
Intellectual property
All standards, frameworks, reports, and other materials published by GIRA are owned by or licensed to the association and are protected by intellectual property laws. Members are granted a non-exclusive, non-transferable licence to use published Content for their internal purposes.
The GIRA and AmberSky names and logos are marks of the association and may not be used without prior written consent.
Data protection & privacy
GIRA processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable national law. Our Privacy Policy describes what data we collect, the legal bases for processing, retention periods, and your rights.
Member-submitted operational data is treated as confidential. Such data is only ever published in Aggregated Data form, anonymised so that no individual Member’s results can be identified.
Accuracy of content & benchmarks
GIRA benchmarks and reports are provided for general industry information. While compiled with care, they are provided “as is” without warranty of accuracy, completeness, or fitness for a particular purpose.
Benchmarks describe industry bands and trends; they are not commercial advice and should not be the sole basis for any business, pricing, or investment decision.
Limitation of liability
To the fullest extent permitted by law, GIRA shall not be liable for any indirect, incidental, or consequential loss, or for any loss of profit, revenue, data, or goodwill, arising from use of or inability to use the Services or any Content.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Governing law & jurisdiction
These Terms are governed by the laws of Belgium, where GIRA is established as an international non-profit association (AISBL). Any dispute shall be subject to the exclusive jurisdiction of the courts of Brussels.
Changes to these terms
We may update these Terms from time to time to reflect changes in the Services, our governance, or the law. The effective date and version are shown at the top of this page.
Continued use of the Services after an update takes effect constitutes acceptance of the revised Terms.
